This Advertising & Content Policy (“Advertising Policy”) shall be applicable to customers of PropertyGuru Pte. Ltd. (“PropertyGuru”) who advertise listings on PropertyGuru’s Platforms (including propertyguru.com.sg and commercialguru.com.sg) as agencies, agents and/or salespersons or are persons who have purchased/subscribed to PropertyGuru’s Products/Services.
1. DEFINITIONS
In this Advertising Policy:
1.1 “Terms of Purchase” means the terms of purchase that apply to you and us in relation to the Products/Services as specified in your Sales Order or available at: https://www.propertyguru.com.sg/customer-service/terms-of-purchase
1.2 “Account”: means your single-user AgentNet account or other individual accounts (including sub-accounts) as described in the Terms of Purchase.
1.3 “Agreement” means this Advertising Policy, the Terms of Purchase, PropertyGuru’s Privacy Policy (https://www.propertyguru.com.sg/customer-service/terms-of-service), PropertyGuru’s Terms of Service (https://www.propertyguru.com.sg/customer-service/terms-of-service, the Sales Order and other
terms and conditions that PropertyGuru may specify in writing as applicable to the Products (including, without limitation, any terms and conditions published on the Platform.
1.4 “Advertisement Material” or “Listings” mean any listing or advertisement material or content placed by you or which you authorise or request us (in writing or verbally) to publish or upload on your behalf on the Platform or any online or offline medium that advertises real estate property(residential or commercial), project launches, property developments or personal/corporate branding and/or any other services or products or
property related ancillary services that we may allow you to advertise or promote from time to time.
1.5 “Platform” means the websites identified in Section B (PropertyGuru Product/Service of the Terms of Purchase (including propertyguru.com.sg and commercialguru.com.sg) and its related desktop website, mobile website, mobile applications (including mobile phone, tablet and wearable applications) and related systems tablet and apps and any other website that PropertyGuru and its affiliates operate and which we allow you to post or upload your Advertisement Material.
1.6 “Product/Service” may include any of the following products or services or a combination thereof which is purchased, subscribed or ordered by
you from us in the Sales Order or the Platform:
- access to our Product/Service to manage your Advertisement Material on the Platform;
- subscription to display your Advertisement Material on the Platform;
- the Product/Service set out in Section B of the Terms of Purchase (PropertyGuru Product/Service); and
- any associated or ancillary service we agree in writing to provide to you.
1.7 “Sales Order” means the sales order, sales order agreement, quotation, invoice, email, document or electronic interface which you sign or
otherwise indicate your agreement to purchase, subscribe, access and/or use our Product/Service;
1.8 “PropertyGuru/We/our/us” means PropertyGuru Pte. Ltd.
1.9 “You/your/the client” means you, our customer being an agency, agent or salespersons who subscribe/purchase PropertyGuru’s Products/Services
1.10 Other terms may be defined below, in this Advertising Policy. Any terms that are not defined in this Advertising Policy shall have the meanings as stated in the Terms of Purchase.
2. INTRODUCTION
2.1 This Advertising Policy is applicable to your use of the Platform to display Advertisement Material for sale or for rent, agent profile information and the agent log-in details to upload property listings for display on the Platform.
2.2 This Advertising Policy forms part of your Agreement with us. Your purchase, access or use of the Platform and/or Product/Service constitutes your acceptance of this Advertising Policy.
2.3 We may change this Advertising Policy at any time by publishing the amended Advertising Policy on our Platform. Your continued use of the Platform and/or any Product/Service following the publication of any amendments to these Advertising Policy constitutes your acceptance of those amended terms of the Advertising Policy. In the event you object to any amended terms of the Advertising Policy, your sole option is to terminate the Agreement by giving us thirty (30) days’ written notice.
2.4 We reserve our rights to maintain the quality of listing and agent profile content on the Platform by making such directions in relation to modification of content that we consider reasonable in the circumstances. The terms of this Advertising Policy are a list of our requirements. We may direct you to modify content that we consider are reasonable in the circumstances.
2.5 We may interpret and apply the requirements below in such reasonable manner that are appropriate in the circumstances having regard to maintaining the quality and integrity of our Platform.
2.6 Council for Estate Agencies (“CEA”): The Council for Estate Agencies (“CEA”) is a statutory board established under the Estate Agents Act 2010 to administer the enhanced regulatory framework for the real estate agency industry. Commencing its operations from 22 October 2010, CEA’s principal functions are to license the estate agents (referring to the estate agencies) and register agents (referring to the property agents/salespersons),promote the integrity and competence of estate agents and engage in public education efforts to help consumers in property transactions. In addition to this Advertising Policy, PropertyGuru will also monitor and moderate all advertisements under its Product/Service and on the Platform, according to CEA’s Code of Ethics and Professional Client Care and Practice Guidelines on Ethical Advertising. All estate agencies/agents and salespersons are advised to be well-versed with CEA’s regulations that can be found on the CEA’s website: www.cea.gov.sg
2.7 PropertyGuru will always cooperate with authorities to help resolve any suspected illegal activities. To preserve the trust of our users, PropertyGuru reserves the right to suspend any agent convicted of illicit activities – even if those activities are unrelated to the use of PropertyGuru Product/Service.
3. YOUR OBLIGATIONS
3.1 You must abide by the requirements of this Advertising Policy.
3.2 You must only use the Product/Service for the purposes for which it was designed and offered and not for any other purpose including, but not limited to, any purpose stated in this Advertising Policy as being not acceptable.
3.3 You must use the Product/Service in a responsible manner, considering the effects your use of the Product/Service may have on other users of the Product/Service and the Platform.
3.4 Account Ownership: each Account shall be used only by the specific individual who has registered for or been allocated the Account. All individuals must be agents/salespersons registered with the CEA.
3.5 Account Name: the name used on the Account should be identical to the name that the agent/salesperson has registered with the CEA.
3.6 Unauthorised Listing: As per CEA’s requirement, all estate agents/salespersons are required to sign relevant Forms 1 to 8 as laid down in the Third Schedule of the Estate Agents Act 2010. Any Listings which fail to comply with this requirement, may be considered unauthorised and the relevant Listing and/or Account may be suspended immediately.
4. ACCEPTABLE USE
It is acceptable to use the Product/Service in the following manner:
4.1 Listings: to use the Product/Service for the bona fide listing of real estate property located in Singapore for sale or rent, on behalf of the person entitled to offer the property for sale or rent and in accordance with this Advertising Policy.
4.1.1 Authenticity of Listing(s): All Listings posted must be genuine, accurate, and available to the market at the time of Listing and throughout the duration they are visible online. Listing(s) found to be false, fake, unauthorised, or misleading will be suspended immediately. It is your sole responsibility to ensure the complete genuineness and authenticity of the Listing and all its information, including, but not limited to, text descriptions, video content, and visual imagery. Specifically, you shall not upload any listings to our Platform for an improper purpose, where an “improper purpose” includes to represent yourself or commit fraud to/against any person by presenting yourself/impersonating a property agent/salesperson or landlord
that is authorised to advertise the property. Where this occurs, you must satisfy us that you have adequate procedures to verify the authenticity of Listings and ensure such Listings are uploaded for a proper purpose, which may include an agency authority with the owner of the property.
4.1.2 Authorisation: to list property for sale or rent to which you have the appropriate permissions and agreements from the property owners, including without limitation individuals, and/or private homeowners and property developers.
4.1.3 Floor Plans:
(a) All listing floor plans must be accurate visual representations of the respective Listings advertised. Hand-drawn floor plans are allowed if they are clearly and accurately presented.
(b) It is the sole responsibility of the agent/salesperson to obtain copyright, license, permission to use, etc to use any information (including artist impressions) from sources such as project brochures. PropertyGuru reserves the right to remove any floor plans and other materials that may breach copyright laws or may otherwise infringe the intellectual property of a third party.
(c) Floor plans found to feature one or more of the following are deemed as irrelevant and/or inappropriate, and the Listing featuring the same will be suspended:
- Floor plan that is not for the advertised property;
- Floor plan that contains any competitor’s watermark, e.g. 99.com, ST Property, H88, SingaporeExpats etc.
- Floor plan of a non-advertised property, even if the property layout and size is the same or it belongs to the same project;
- Unclear and/or low-quality floor plan;
- Floor plan which contains a reference to another person other than the agent/salesperson advertising the property; and/or
- A combination of multiple floor plans.
4.1.4 New Project Listing(s): Agents/salespersons and project marketing teams are advised to obtain relevant authorisations from the respective project developers before listing new projects. Repetitive listings of similar unit types with several indicative prices are deemed duplicate listings and will be suspended immediately.
4.1.5 Listing Photos:
(a) to upload at least one (1) Listing photo of the property in the Listing(s) which is of high resolution and is clear and not broken or opaque;
(b) You shall only display a Listing photo of the property advertised for sale or rent, unless the Listing refers to an office, apartment, condominium, or town house; in which case a photo of the building or neighbouring buildings can be displayed. Duplication of photographs is not permitted for a Listing;
(c) All Listing photos must accurately represent the Listings advertised. Photos depicting the property’s interior must be genuine and accurate representations of that exact unit at the time; they must not be photos of a similar/different unit, nor of the same unit but in a different condition.
(d) If your Listing photos are found to feature one or more of the following which are deemed irrelevant and/or inappropriate, your Account will be suspended:
- Photos are not of the advertised property and are not an accurate representation of the advertised property, for example:
- Listing features photos of the Agent/salesperson or their name card;
- Amenities, such as shopping centres, that are not within a reasonable distance to the advertised property;
- Photos that contain non-property content, such as text or images of people (in photos or overlaid);
- Photos that are not rotated to the correct orientation;
- Unclear and/or low-quality photos;
- Photos that contain other property portal/website’s watermark, e.g. 99.com, ST Property, H88, SingaporeExpats etc;
- Photos that belong to a third party and are used without permission;
- Duplicated photos;
- Photos with human models, landmarks or with trademarks are prohibited;
- Photos of a diagrammatic table;
- Photos that contain text only;
- Photos that are made up of more than 1 image (collaged);
- Photos that are floor plans or maps; and/or
- Photos that contain elements or features that are irrelevant to the visual showcasing of the property itself, e.g. coloured borders around the photos.
4.1.6 Rules for Content Containing Video/Moving Images/3D Tours (“Video”):
(a) Each Video on a Listing must advertise a property for sale or rent and focus predominantly on the property. You must not use Video to advertise yourself or your agency, except that you may include a transparent watermark of your agency logo in one corner of the Video with dimensions no greater than 10% of the total image size (i.e. 80 pixels by 60 pixels) that does not obstruct the Video content. All Videos must accurately represent the Listings they advertise.
(b) Images and sounds in Videos must relate to the property being offered for sale or rent. Displaying a ‘lifestyle’ image or commenting on ‘lifestyle’ features is acceptable (e.g. a view from the property or an image of some local environmental or structural feature or amenity) provided the property remains the principal focus of the Video.
(c) You must not use the Video functionality in a way that is likely to mislead or deceive users of the Platform.
(d) You must adhere to the technical requirements for embedded property Videos communicated to you from time to time.
(e) You must not use the Video functionality for any unlawful, illegal, malicious or improper purpose e.g. it is not acceptable to display images or include commentary that:
- may defame or discredit another person or business;
- may disclose private, personal or confidential information;
- may be considered obscene, offensive, menacing or abusive;
- you do not own nor have a licence nor permission to upload onto our Platform for us to display to our users;
- may infringe or cause us to infringe the intellectual property rights of others;
- contain content relating to ethnicity, religion, race, interfaith matters and/or which may create any disharmony; and/ormay violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.
(f) You must not include any agent/salespersons contact details (e.g. phone, skype, email, social media or website address) other than the agency name.
(g) You must not include any links to third party websites or other tools with additional functionality (e.g. contact an agent, enquiry or booking call-to-actions such as ‘book inspection’ or ‘contact agent’, hyperlinks, URLs, QR codes or any other form of link or direction to any website or application, unless expressly authorised by PropertyGuru.
(h) The above rules apply to all forms of moving images permitted by PropertyGuru for use on our Platform including images involving video, animated, virtual, rendered and scanned technologies. The rules apply to images and sounds in Videos, including without limitation Clauses 4.1.6 and 6 of this Advertising Policy.
(i) It is the sole responsibility of the agent/salesperson to obtain copyright, license, permission to use, etc to use any third-party intellectual property (including artist impressions) from third party sources such as project brochures. PropertyGuru reserves the right to remove any content (including floor plans) that that may breach copyright laws or may otherwise infringe the intellectual property of a third party.
(j) Videos found to feature one or more of the following are deemed as irrelevant and/or inappropriate, and will be suspended:
- Video that does not feature the advertised property;
- Video that is of one or multiple property photos stitched together;
- Video that does not show the interior of the advertised property. For example:
- Video featuring the surrounding amenities of the property only;
- Video featuring the agency/agent/salesperson’s achievement only;
- Video taken from YouTube, Vimeo, or any online video streaming site without permission;
- Unclear and/or low-quality Video;
- Video that contains a reference to another person other than the agent/salesperson advertising the property; and/or
- Video links which are broken.
4.1.7 You shall remove a Listing from the Platform promptly if the property is not available for sale or rent in the market, otherwise you will be penalised for being in breach of Clause 6.1 of this Advertising Policy.
4.1.8 The primary language of all descriptions shall be English. Descriptions in other languages are allowed as a secondary language.
4.2 Agent profile name and photo:
4.2.1 A photo of the individual profiled agent’s face in your agent profile image field (e.g. passport photo). Logos and/or symbols are prohibited in this field.
4.2.2 Your personal name in the agent profile name field, which matches Your Account registration name. Agency name, multiple agents’ names or areas of practice are prohibited in this field.
4.2.3 You are required to ensure that your Account profile and details, including agency license, salesperson’s license, salesperson’s mobile number(s) and photo are to be current and up to date at all times, as registered with the CEA.
4.2.4 Agent’s personal webpage/website’s links included in the Agent Profile should contain listing(s) advertised on propertyguru.com.sg or commercialguru.com.sg with up-to-date information
4.3 Race Preference Indication: Agents are not allowed to indicate race or ethnic preferences in any advertisements, Listings, and Agent Profiles unless in accordance with the Singaporean Government’s Ethnic Integration Policy and/or the Non-Citizen Quota for Renting Out a Flat. Listing(s)found with such indications/preferences will be suspended immediately.
4.4 Co-broking: Agents/salespersons are advised to adhere to CEA’s co-broking regulations and requirements. Any reported violation may be investigated and forwarded directly to the CEA.
5. WHAT IS NOT ACCEPTABLE USE?
It is not acceptable use of the Product/Service to engage in any of the following practices, or to allow anyone else to engage in the following practices, in using the Product/Service:
5.1 Listings other than real estate: do not list anything other than real estate property for sale or rent (e.g. it is not acceptable to list cars, car spaces, boats, caravans and portable homes on the Platform).
5.2 Advertising your business or your agents/salespersons: do not use the Product/Service to advertise your business or your agents/salespersons in a Listing. Each Listing uploaded by you must be a bona fide Listing of real estate property for sale or rent. For example: using the Product/Service to advertise your business or its services as a property agent/salesperson is not acceptable. It is also not acceptable to include dedicated marketing content about your agency or agents/salespeople within a Listing, including images (such as photographs of agents) or text within the photo gallery.
5.3 Competing with us: do not use the Product/Service to advertise the business or services of our competitors.
5.4. Incorrect categorisation of properties for sale: do not use the Product/Service to:
(a) list properties for sale or rent other than in accordance with Clause 4 above;
(b) list properties for sale in the ‘Rent’ section of the Platform; and list properties for rent in the ‘Buy’ section; and/or
(c) list primary property Listings (e.g. New Project/Launches) in the secondary property Listings category (properties available for re-sale e.g. “Buy”, and vice versa.
5.3 Generic listings: do not use the Product/Service to list properties which do not specify the lot number or address (for example ‘various properties available’ is not acceptable).
5.4 Misuse of fields: do not use the Product/Service to place false or irrelevant information in an information description, price or picture field of a Listing. You must only use the information, description or picture fields to insert information that is intended for those fields. For example, do not insert repeated words, keywords, the name or contact details of your business, or agency, vendor, property owner or landlord in the description header or property description field. Spamming of advertisements and keywords is prohibited.
5.5 Watermarks in photos: do not insert any name, telephone number, address, website or logo of any individual, company or competitor as a watermark in any Listing. All watermarks for Listings must only utilise Propertyguru’s watermark system.
5.6 Incorrect photos or pictures: do not use the Product/Service to display photos of properties other than the property for sale or rent. For example: ‘Too Early for Picture’ or ‘Sample Picture’ or images of cartoon houses are also not acceptable.
5.7 Borders around photos or pictures: do not display a photograph, drawing or other image within a border that detracts from the quality of the image on a Listing.
5.8 Text or marketing in photos or pictures: do not display text within a photograph, drawing or other image that detracts from the quality of the image on a Listing, or do not display any agency marketing material through the use of branded objects in photos, such as signboards, cars and coffee cups.
5.9. Photo/image collages: do not display a collage or combination of photos or other images within one frame on a Listing.
5.10. Displaying ‘lifestyle’ images as main image: do not display a ‘lifestyle’ photograph, drawing or other image as the main image in a property listing. We will have discretion to determine what constitutes a ‘lifestyle’ image for this purpose, but for guidance a lifestyle image will commonly be an image of some local environmental or structural feature or amenity, and not an image of the exterior or interior of the property itself.
5.11 False/incorrect street and place names: do not use street names, suburbs or location names that are inaccurate or not officially recognised. For example: stating that a property is within a neighbouring suburb is not acceptable.
5.12 Duplicate Listing of properties: do not use the Product/Service to create multiple Listings (more than one [1] Listing) for the same property. For example, do not list the same property more than once, including but not limited to, Listings with different prices, address details, property types selected or listings loaded into multiple sections on the Platform. If you wish to upload a Listing for the same property you shall first remove the previous Listing for the same property. PropertyGuru are entitled to take necessary action, including but not limited to suspension of your Product/Service with immediate effect, if you upload such duplicate Listings.
5.13 Multiple Listings at the same street address: do not list more than five (5) unique properties in a single Listing at the same street address (e.g. using the same titles, images or descriptions for these Listings is prohibited. Using a showroom or generic photo without reference in the Listing to the fact that the image is not that of the property advertised is also unacceptable).
5.14 Multiple Projects/Units in a single Listing: do not advertise multiple (two [2] or more) projects and/or units in a single Listing. Only one unit from one project, with a single size and price, is allowed per Listing. Should a single Listing be detected to have multiple projects or units advertised within it, PropertyGuru reserves the right to suspend your Product/Service immediately.
5.15 Listing without authority: do not list property that you have not been permitted or authorised to sell or rent and for which you do not have a signed authority from the owner or vendor.
5.16 Impersonating other persons: do not list/use the Product/Service to impersonate another person or represent yourself as any other person/s.
5.17 Reselling the Product/Service or its contents: do not resell the Product/Service or its contents to any other person. If you are Listing a property, you must be representing the owner or authorized person in the sale or rental of that property at all times for the duration of the Listing and managing all enquiries from potential buyers and renters on their behalf.
5.18 Allowing others to use the Product/Service: do not use the Product/Service to advertise properties for sale or rent for another person (including other agency/agent/salesperson) who is not an active/current subscriber to the Product/Service with PropertyGuru.
5.19 Misleading or deceptive conduct: do not use the Product/Service in a way that does or is likely to mislead and deceive the users of the Platform, including without limitation:
(a) uploading new Listings in the incorrect location, even if subsequently moved to the correct location;
(b) including false or misleading information in the descriptive text of an agent profile in the ‘Find Agents’ tab of the Platform; or
(c) quoting inaccurate, incorrect price or unrealistic rental or selling price. For example, do not indicate zero as the rental or selling price.
5.20 Overseas property listings: do not advertise real estate property located outside of Singapore.
5.21 Auction listings: do not post or continue to post auctioned real property listings after the auction date.
5.1.22 Unlawful or malicious content: do not use, upload or transmit content or photos in the Listing that:
(a) may defame or discredit another person or business;
(b) may disclose private, personal or confidential information;
(c) may be considered indecent, obscene, offensive, menacing, humiliating or abusive;
(d) may infringe or cause us to infringe the intellectual property rights of others;
(e) contain content relating to ethnicity, race, religion, interfaith matters, gender, age, nationality, physical or mental ability and/or which may create any disharmony; or
(f) may violate any law, regulation, standard, content requirements or code promulgated by any relevant authority or industry body.
5.23 Software, bots, viruses and bugs: It is prohibited to use, upload or transmit any of the following:
(a) any automation software, hacks, mods or any other unauthorized third-party software designed to access, crawl or collect from/to our Platform, Product /Service; and
(b) any unauthorized third-party software that intercepts, ‘mines’ or otherwise scans/collects information from or through our Platform, Product/Service.
6. BREACHES OF THIS ADVERTISING POLICY
6.1 If you use the Product/Service and/or Platform in a way that breaches this Advertising Policy, you shall be in breach of a material obligation in your Agreement with us for your use of the Product/Service.
6.2 If you breach this Advertising Policy, we are entitled to take action to remedy the breach, including without limitation, terminating or suspending your Product/Service and/or Account; deleting a specific Listing, deleting your agent profile, prohibiting a Listing from being uploaded to the Platform or any other action that we deem fit, according to this Agreement and/or law.
6.3 Persistent violation of any part of this Advertising Policy may lead to suspension of your Account, without the right to claim refunds of service fees or to extend the package. All ‘Active’ and ‘Past’ Listings will be moved to ‘Suspended’.
6.4 For the avoidance of doubt, if we give you notice of a breach or breaches of this Advertising Policy, we may require you to remedy those breaches within a specified period of time. We reserve our rights to take action as described in Clause 6.2 where you are in breach of ANY requirement of this Advertising Policy at any time after the period specified in such a notice (and not only where you are in continuing breach of the specific requirements
identified).
6.5 Where we suspend or delete Listings or Listings are prevented from being uploaded due to a breach or attempted breach by you of this Advertising Policy, you will remain liable for your contractual obligations until the date of termination or expiration of your Agreement with us. For the avoidance of doubt, we may exercise our right to suspend or remove your Listings permanently or temporarily for any period that we deem fit.
